Firearms and Ammunition - As enacted, declares that the general assembly occupies the whole field of regulation of firearms, ammunition, components of firearms or ammunition, or combinations thereof, prohibiting local regulation, with certain exceptions. - Amends TCA Section 39-17-1314.

    Bill Summary

    Present law generally prohibits local governments from regulating the transfer, ownership, possession or transportation of firearms, ammunition or components of firearms or combinations thereof; except:
    (1) In the case of ordinances or resolutions lawfully enacted before April 8, 1986; and
    (2) A local government may prohibit persons from possessing a handgun while within or on a public park that is owned or operated by the local government.

    This bill prohibits local governments and state government entities from regulating the use, transfer, ownership, possession, discharge, or transportation of firearms, ammunition or components of firearms or ammunition, or combinations thereof; however, this bill does not delete the present law authorization for local governments to prohibit handgun possession in local parks.

    ON APRIL 9, 2014, THE SENATE ADOPTED AMENDMENT #2 AND PASSED SENATE BILL 1612, AS AMENDED.

    AMENDMENT #2 adds exemptions from the preemption set out by the bill, which is described in the second paragraph of bill summary, allowing a city, county town, municipality, or metropolitan governing to regulate by ordinance, resolution, policy, rule or other enactment the following situations:

    (1) Except as otherwise provided in the laws governing the transportation and storing a firearm or ammunition in a permit holder's vehicle, the carrying of firearms by employees or independent contractors of the city, county, town municipality or metropolitan government when acting in the course and scope of their employment or contract;
    (2) The discharge of firearms within the boundaries of the applicable city, county, town, municipality or metropolitan government, except when and where the discharge of a firearm is authorized or permitted by state law;
    (3) The location of a sport shooting range, except as otherwise provided by law; and
    (3) The enforcement of any state or federal law pertaining to firearms, ammunition, or components of firearms or ammunition, or combinations thereof.
