Education, State Board of - As enacted, clarifies that pleas of guilt and nolo contendere to certain criminal offenses subject an educator to automatic revocation of an educator license by the state board; specifies that criminal offenses committed in another jurisdiction that are equivalent to those that if committed in this state subject an educator to automatic revocation of an educator license similarly subject an educator to automatic revocation of an educator license by the state board. - Amends TCA Section 49-5-417.

    Bill Summary

    Present law requires the state board of education to automatically revoke the active license of a licensed educator without the right to a hearing upon receiving verification of the identity of the educator together with a certified copy of a criminal record showing that the educator has been convicted of certain offenses, including, but not limited to, (i) communicating a threat concerning a school employee; (ii) statutory rape by an authority figure; (iii) arson or aggravated arson; (iv) a burglary offense; (v) child abuse, child neglect, or child endangerment; (vi) aggravated child abuse, aggravated child neglect, or aggravated child endangerment; (vii) providing handguns to juveniles; and (viii) a sexual offense or a violent sexual offense.

    This bill adds to the present law by also requiring the state board of education to automatically revoke the active license of a licensed educator without the right to a hearing upon receiving verification of the identity of the educator together with a certified copy of a criminal record showing that the educator pleaded guilty or nolo contendere to any of the above offenses.

    Present law requires a director of schools, director of a public charter school, or director of a nonpublic school who learns of the conviction of a licensed educator employed by the LEA, charter school, or nonpublic school, respectively, for any offense listed above to report the conviction to the state board. The state board must set the time frame within which the director must report a conviction of a licensed educator. The state board may specify other offenses that a director is required to report upon learning of a conviction of a licensed educator for such offense.

    The bill adds to the present law by also requiring a director who learns that a licensed educator has pleaded guilty or nolo contendere to an above offense to report the educator to the state board.
